Family of Nanny Who Died In Syosset Swimming Pool Accident Has Questions

The family of a nanny who gave her life saving a 3-year-old boy from drowning in a Syosset swimming pool accident is questioning the circumstances of her death. According to a news report posted on Eyewitness News’ Web site, the nanny, Anna Montana, jumped in the pool when the toddler fell in although she did not know how to swim. The nanny died while the boy survived.

When police and emergency personnel arrived at the home, the boy’s mother was with her son inside the home while Montana was lying facedown in the water. Paramedics were able to resuscitate the boy, but not the nanny. Montana’s family is now wondering why no one attended to her or tried to help her. Montana’s relatives believe that this tragedy could have been averted and that she was put in a dangerous position because of her inability to swim.

Overloaded Dump Truck Loses Control, Kills One and Injures Six

An out-of-control dump truck, which officials say, may have been overloaded with dirt smashed into a Chinatown bus as it came off the Manhattan Bridge. One person was killed and six were injured in the fatal truck accident. According to an article in the New York Daily News, the dump truck started to careen wildly before it hit the back of a Fung Wah bus near the intersection of Bowery and Canal streets, killing 57-year-old Lai Ho and injuring several others.

Investigators are now looking into whether the truck had been loaded with dirt beyond its capacity. News agencies also reported that the truck should never have been in the city because federal officials had banned the New Jersey-based truck company from interstate travel because of too many safety violations.

Jury Awards $510,000 to Boy Injured in Schoolyard Mishap

In 2004, a 9 year old boy broke his femur in a collision with another child as they ran to line up after recess. A Passaic County jury decided that the school was negligent in supervising the children because the school only had one teacher supervising 400 children. The child suffered permanent debilitating injuries. According to the boy’s attorney, the school system only offered $5,000 to settle the case. A jury felt otherwise and awarded $500,000 for the child’s pain and suffering.

Minor injuries to our children are an inevitable part of the growing up process. When those injuries, however, are the result of the negligence of another party, it can be very unsettling. An unsafe swimming pool or faulty playground equipment can lead to injuries that were similar to the ones the Passaic County youth suffered from. Additionally, unsafe child products, such as defective car seats, strollers, cribs, and toys can play a large role in injuries sustained by our children.

If your child has been injured at school or summer camp or by an unsafe toy or product, you should contact an attorney as soon as possible to determine if there is any liability. Contact the attorneys at Lependorf & Silverstein if you have any questions.
