Fatal School Bus Accident in Chesterfield Raises Many Questions

Officials are still investigating a fatal school bus accident in Chesterfield, which left an 11-year-old girl dead and 17 other elementary school children injured. The girl, who was the daughter of a state trooper, was a triplet. Both her sisters and another 11-year-old boy were critically injured in the crash, according to a news report in The Times of Trenton. Officials say the collision occurred at a street intersection between the school bus and a dump truck. Among other issues, officials are looking into which one of the drivers was at fault for the fatal auto accident. The National Transportation Safety Board (NTSB) is looking into several issues including seatbelt use. New Jersey is one of only six states that require the use of seatbelts in school buses.

Another issue in such cases that warrants close examination is whether the accident occurred at a dangerous location. The news report states that the intersection of Route 528 and Old York Road, where this accident occurred, has been the site of 17 car accidents over the last five years. There were two crashes at that intersection just this year.

Any time there is blunt force trauma to the head there is the potential for a concussion. Slip-and-fall head injuries can be very serious and the symptoms can get worse over time if they are not properly diagnosed and treated.

NJ Slip Fall AccidentDetermining if you have suffered a concussion is not always easy. What Are the Rights of Bicyclists in New Jersey?

Princeton Bicyclist Accident InjuryIn New Jersey, bicyclists have the same right-of-way privileges as motorists, and riders who choose to walk their bike have the same privileges as pedestrians. It is important for all bicyclists to understand not only the rules of the road, but also their legal rights should they become involved in an accident. Anyone injured in a New Jersey bicycle accident may have to prove that he or she was riding safely and legally, and that someone else’s negligence caused or contributed to the accident. This is often necessary for the injured bicyclist to receive monetary compensation for his or her injuries, damages, and losses.

Under New Jersey statute 39:4-14.1: “Every person riding a bicycle on a roadway is granted all the rights and subject to all of the duties of the motor vehicle driver.” This means that riders must obey traffic signals and all drivers must yield the right-of-way to bicyclists who have already entered an intersection.

Under N.J.S.A. 39:4-14.2 and 39:4-10.11: “Every person riding a bicycle on a roadway shall ride as near to the right roadside as practicable exercising due care when passing a standing vehicle or one proceeding in the same direction.” Riders may move left to avoid debris or other hazardous conditions, to pass a slower moving vehicle or when travelling at the same speed as other traffic.

Woman in Wheelchair Struck by Car in Newton

A 76-year-old woman was injured in a New Jersey pedestrian accident when a car struck her as she crossed the street in an electric wheelchair. According to a report by The Star-Ledger, the pedestrian accident occurred near the intersection of Trinity Street and Water Street in Newton. Officials say the woman was crossing the road outside of a crosswalk but near an intersection when the car struck her. The Sussex woman was taken by helicopter to a medical center with a head injury. The 61-year-old female driver from Franklin has not been cited for the collision.

Under New Jersey law, individuals in wheelchairs have the same right-of-way privileges as pedestrians. Drivers are required to yield the right-of-way to pedestrians in crosswalks and at intersections. When a collision occurs outside of a crosswalk, it must be determined if either the pedestrian or the driver failed to exercise due care.

Pedestrians crossing outside of a crosswalk must yield the right-of-way to oncoming traffic. This does not, however, excuse drivers from exercising due care to avoid pedestrians. There are several questions that must be asked in these cases. Why was the motorist unable to avoid the collision? Was the driver exceeding the speed limit? Was the driver distracted or inattentive at the time? Negligent drivers may be held financially liable for the damages they cause even if they are not cited for the crash.

Victims of pedestrian accidents may file a personal injury claim against a negligent driver. In such cases, a skilled personal injury lawyer can help the victim pursue compensation for medical bills, lost wages and other related damages. The experienced NJ personal injury lawyers at Lependorf & Silverstein help pedestrians get fair compensation for the injuries and damages they have suffered. Pedestrian Critically Injured in Plainsboro Crash

A 62-year-old man was seriously injured in a recent New Jersey pedestrian accident after a vehicle struck him as he crossed the street. According to a news report in The Times of Trenton, the pedestrian accident occurred at Dey Road and Edgemere Avenue in Plainsboro. Officials say the man was crossing the road at the intersection when a Mercedes struck him. He suffered serious injuries and has been listed in critical condition. No charges have been filed against the 45-year-old South Brunswick man who was driving the Mercedes, but an investigation is underway.

Drivers must yield the right-of-way to pedestrians who are legally crossing the roadway at an intersection. N.J.S.A. 39:4-36 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within a marked crosswalk or within any unmarked crosswalk at an intersection.”

Anytime a collision between a pedestrian and a vehicle occurs, it must be determined if either party failed to exercise due care and if negligence was a contributing factor. Was the car’s driver distracted or speeding? Was the driver under the influence or driving carelessly? In cases involving negligence or wrongdoing, the at-fault driver can be held liable for the damages suffered by the victim. In such cases, compensation may be available to victims for medical bills, lost wages, hospitalization costs, and other related damages.

The experienced NJ pedestrian injury lawyers at Lependorf & Silverstein help injured pedestrians get the compensation they need and rightfully deserve. Elderly Driver Injured in Washington Township School Bus Accident

An elderly driver was recently injured in a New Jersey car accident involving a collision between a car and a school bus. According to a news report in The Gloucester County Times, the bus accident occurred at Hurffville-Cross Keys Road and Theresa Way in Washington Township. Officials say the driver of the car was trapped behind the steering wheel and was airlifted to a hospital with chest pains. Of the four or five passengers on the bus, it appears that only one suffered a minor injury. It is not clear how the collision occurred or if either driver will be cited for the crash.

There are many questions that must be asked by investigators following a school bus accident. Did the car’s driver fail to stop for the school bus? Did the bus driver fail to yield the right-of-way when entering traffic, changing lanes, or making a turn? Did passengers on the bus distract the bus driver? Did the driver have proper training and the required licensing to safely operate the bus? Did bus maintenance play a part?

Potentially liable parties for a bus accident include the bus driver, the bus company, the owner of the bus, or another negligent driver. Chesterfield, NJ School Bus Accident Kills 11-Year-Old Daughter of State Trooper

The Washington Post reports that a school bus accident in New Jersey killed an 11-year-old girl and critically injured three other students, two of whom are the triplet sisters of the little girl who died. The bus, which was carrying 25 elementary school students, collided with a dump truck at a four-way intersection in Chesterfield, sending the large vehicle into a traffic signal pole and crumpling the side of the bus. The driver of the school bus was identified as a 66-year-old Beverly resident, and the dump truck driver is a 38-year-old resident of New Egypt.

Authorities report that 17 students suffered injuries, most of them minor. The 11-year-old girl who tragically lost her life was the daughter of a New Jersey state trooper. Her two sisters, along with another young boy, were listed in critical condition at Cooper University Hospital in Camden. Students with less minor injuries were taken to other area hospitals for treatment.

Presently, no charges have been filed against the drivers and the investigation is ongoing. A community vigil is scheduled to be held Thursday, February 17, at the Chesterfield Baptist Church.

Though bus accidents account for a small percentage of traffic accidents, when one occurs, the consequences can be severe for those onboard, with serious injuries and fatalities happening as a result of the collision. A 2009 study conducted by the U.S. Federal Motor Carrier Safety Administration (FMCSA) concluded that human factors and error, such as inattention or misjudgment, were the main causes of 90 percent of the bus crashes examined. An injury or fatality that occurs while an individual is using bus transportation may entitle that person, or his or her family members, to compensation.

The knowledgeable New Jersey school bus crash attorneys of Lependorf & Silverstein are committed to helping individuals who have been injured, or lost a loved one, in a bus accident obtain compensation for their losses and injuries. New Jersey Police Investigate 3-Year-Old Child’s Death during Dentist Visit

A 64-year-old dentist in Irvington is under investigation after a three-year-old boy died while undergoing a routine dental procedure. The New Jersey Division of Consumer Affairs is investigating the incident and it has been revealed that the dentist is already on probation from the Board of Dentistry for an incident in 2004 where a six-year-old girl died while under his care, according to CBSNews.com.

Reportedly, the boy had come into the office to have cavities filled. For the procedure, he was placed in a cocoon-like restraint system and given local anesthetic, but at some point during the process went limp and stopped breathing. The boy was taken to a hospital, but was later pronounced dead from the fatal New Jersey accident. According to investigations, the first child who died had passed away from natural causes due to serious medical conditions and not because of medical malpractice, but the dentist was still put on a lengthy probation sentence.

Authorities are currently investigating the cause of the three-year-old boy’s death and if there should be any criminal charges filed against the dentist for the incident. Families of both victims are now pressing to have the dentist’s license revoked.

Undergoing any sort of medical procedure is a delicate and complicated process that puts the life of a patient in the hands of medical professionals. As such, when the negligence or oversight of medical professionals results in the death of a patient, his or her family can seek compensation from those responsible. Are Certain Breeds of Dogs More Dangerous than Others?

Pit bull and Rottweiler activists often claim that it is not the breed of the dog but the quality of the owner that determines whether a dog is dangerous or not. While an attentive owner can keep a dog calm and well behaved, it doesn’t change the fact that some dogs are simply capable of doing more harm than others.

New Jersey Dog Bite DangerDogsBite.org, a national advocacy group for dog bite victims, recently released dog attack statistics for the United States in the year 2011. While not all pit bulls are dangerous, the numbers do not lie. Despite only making up five percent of the U.S. dog population, pit bulls were involved in 71 percent of the 31 fatal dog attacks reported last year. Pit bulls are as dangerous to their owners as they are to others. In fact, 88 percent of the dog owners who were fatally injured by their own pets were killed by a pit bull. They are not, however, the only dangerous breed.

The Rottweiler is the other breed most often involved in fatal attacks. Between the years 2005 and 2011, pit bulls and Rottweilers together accounted for a combined 73 percent of all dog bite-related deaths. In other words, a pit bull or a Rottweiler was involved in 156 of the 213 fatal dog attacks over the past seven years.

Anyone injured by a dog, regardless of the breed, would be well advised to seek out medical attention and a consultation from a skilled dog bite attorney. The Princeton dog attack injury lawyers at Lependorf & Silverstein have a long history of getting dog bite victims the compensation they need for medical bills, time away from work and other related damages. A 42-year-old woman was killed in a New Jersey car accident when a Chevrolet Blazer struck her as she crossed the street. According to a news report in The Gloucester County Times, the fatal pedestrian accident occurred on Delsea Drive near the ShopRite Supermarket in the Rio Grande section of Middle Township. Officials say the woman was crossing the road when the southbound car struck her. It is not clear if the 77-year-old driver from Goshen will be cited for the crash. The report does not state if the victim was in a crosswalk or near an intersection.

Under New Jersey statute 39:4-36, motorists must come to a complete stop at crosswalks when pedestrians are crossing. New Jersey law also requires all pedestrians to obey pedestrian signals and to cross at signalized intersections. Under tort law, injured victims of driver negligence may pursue financial compensation from the at-fault motorist. Preventing Super Bowl Weekend Drunk Driving Accidents

Super Bowl weekend is nearly upon us. As we gather with friends to watch the New York Giants take on the New England Patriots, it is important we remember that there will be an increased number of drunk drivers on the roadway. Every Super Bowl weekend, motorists who have been drinking while watching the game take to the roadway assuming that they are capable of driving safely. If you are celebrating the Super Bowl game with friends, please remember to use caution and drive safely.

Super Bowl Drunk DrivingAccording to the National Highway Traffic Safety Administration (NHTSA), Super Bowl Sunday has become one of the most dangerous days nationwide on our roadways because of fatal auto accidents caused by impaired drivers. The NHTSA states that 48 percent of fatalities nationwide on Super Bowl Sunday involve a driver with a blood alcohol concentration of 0.08 percent or higher.

If you drink this Super Bowl Sunday, please do not make the mistake of thinking you are sober enough to drive. It only takes two to four drinks for a driver to be considered under the influence of alcohol. Any amount of alcohol can impair your ability to think clearly, focus, and react appropriately to your surroundings on the roadway.

Bicyclist Killed in New Brunswick Hit-and-Run Car Crash

A 26-year-old man was recently killed in a New Jersey bicycle accident involving a hit-and-run driver, according to The Star Ledger, on Georges Road in New Brunswick. Officials say the New Brunswick man was riding his bicycle when a dark-colored Toyota 4Runner, built between 1995 and 2002, crossed into oncoming traffic and struck him. The 26-year-old bicyclist was pronounced dead at the scene of the crash. The 4Runner immediately left the scene of the accident. Officials are looking for the public's help to track down the hit-and-run driver.

New Jersey motorists are legally required to stop and remain at the scene of an accident when someone has been injured or killed. According to N.J.S.A. 39:4-129: "The driver of any vehicle, knowingly involved in an accident resulting in injury or death to any person shall immediately stop the vehicle at the scene of the accident or as close thereto as possible but shall then forthwith return to and in every event shall remain at the scene until he has fulfilled the requirements of subsection," including contacting the authorities and exchanging information with the injured victim.

The family of someone killed in a New Jersey hit-and-run accident would be well advised to discuss how to pursue compensation for the victim's wrongful death with an experienced personal injury lawyer. A skilled attorney can inform families in such cases about how they may seek compensation through the uninsured motorist clause of their own auto insurance policy in cases where the hit-and-run suspect is not found.

Tips to Prevent Bicycle Accidents in New Jersey

NJ Bike CrashBicycle riders are prone to suffering devastating injuries whenever they are involved in a collision. While no amount of safety precautions can prevent all New Jersey bicycle accidents, there are steps that bicyclists can take to help prevent being struck by a vehicle.

One of the most important steps for bicyclists to staying safe on the roadway is to make themselves seen. All riders should wear bright and reflective gear while riding, whether it is dark out or not. Bicycles should have a white flashlight on the front near the handlebars and reflectors on the back of the pedals and behind the seat. Bicyclists should also make it a habit to not enter an intersection until they have made eye contact with any nearby driver. Assuming that you are seen by a driver can be a tragic mistake.

All bicyclists would be well advised to ride facing oncoming traffic and to stay to the far left side of the shoulder. Cycling routes should be preplanned around roadways with safe and wide shoulders and adequate street lighting. Last, but not least, New Jersey bicyclists should always remember to wear a helmet, which has been proven to help prevent catastrophic head injuries and fatalities.
