Whenever someone is killed in a New Jersey car accident, it must be determined who was at fault and how the crash could have been prevented. In many cases, the cause of the crash is driver error. A moment of distracted driving, for example, is all it takes for roadway and traffic conditions to change and for an accident to happen. Therefore, investigators will typically look into if the at-fault driver was distracted, speeding, impaired, fatigued or otherwise careless. Depending upon the results of the investigation, the driver may face traffic citations or even criminal charges.
A driver does not, however, have to be charged by the authorities to face civil litigation from the victim’s family. The family of someone killed in a New Jersey car accident may seek financial compensation for their tragic loss by filing a wrongful death claim. A successful claim can result in support for medical and funeral expenses, lost future income, pain and suffering and other related damages.
These types of accidents, however, become more complicated when the at-fault party is a truck driver. In such cases, the truck driver, his or her insurance, the truck owner or trucking company may get involved. It is important for victims of New Jersey truck accidents to receive guidance throughout the claim process to ensure that fair compensation is offered from the parties responsible for the accident.
